The rules your booking runs on – what we owe you, what you owe us, and what happens when a mountain road decides otherwise. No small print games.

The clauses below are what actually govern your booking. This is the plain-language headline so you know which sections to read properly.

About these terms

These terms apply between you and Swaminarayan Pashupatinath Yatra (OPC) Pvt. Ltd., trading as Trip Nepal, of AD Mall, 1st Floor, Vijay Chowk, Gorakhpur - 273001, India.

They cover every enquiry, quotation and booking you make with us, whether through this website, on WhatsApp, over the phone or at our office. By confirming a booking or paying an advance, you accept them on behalf of everyone travelling on that booking – so please pass them on to the rest of your group.

Your written confirmation is part of these terms. Where it sets out something specific to your trip – the itinerary, the price, the inclusions, the cancellation schedule – that document takes precedence over the general wording on this page.

How a booking is made

A quotation is not a booking. Prices and availability quoted to you hold only for as long as the suppliers hold them for us, and in busy seasons that can be short.

Your booking becomes a contract when both of these have happened:

  • You have paid the advance stated in your quotation, and
  • We have sent you a written confirmation

Until that confirmation reaches you, nothing is held. Please check it as soon as it arrives – names, dates, room types, traveller counts – and tell us within confirm your checking window if anything is wrong. Corrections after that point may carry supplier charges.

Prices, inclusions and exclusions

Every quotation carries an inclusions list and an exclusions list. Read both. Unless your quotation says otherwise, the following are normally not included:

  • Travel insurance of any kind
  • Personal expenses – laundry, phone calls, drinks, shopping
  • Tips for guides, drivers and porters
  • Anything described as optional, and activities not listed in the itinerary
  • Costs arising from delay, disruption or a change you request
  • Medical costs and emergency evacuation

Prices are quoted per person on the room-sharing basis stated. Travelling alone usually costs more per head, because a room costs what it costs.

When a price can change

We hold your confirmed price except where something outside our control moves it – a government fee, a permit charge, a fuel or exchange-rate movement, or a tax change. If that happens we will show you the reason and the exact difference in writing before anything is payable, and you may state what the traveller may do – e.g. accept, amend or cancel with a defined refund.

Payments

The advance amount and the date the balance falls due are stated in your confirmation. If the balance is not paid by that date, we may treat the booking as cancelled and apply the cancellation charges in clause 5.

How to pay

By QR, UPI, bank transfer, or cash at our office – all set out on the online payment page, where you also submit your transaction reference and payment proof so we can match it to your booking.

Pay only into the accounts named in your written confirmation, and pay cash only at our office against a signed, stamped receipt. No employee of Trip Nepal is authorised to collect cash elsewhere or to ask you for a PIN, OTP or password. If you receive such a request, stop and call our office number.

Keep your receipts. They carry the reference number your booking is tracked by, and they are what settles any question later.

Cancellation by you

Cancellations must reach us in writing – email or WhatsApp to our official number is fine. The charge depends on how many days before departure we receive that notice, because by then we have already committed money to hotels, transport and permits on your behalf.

Some items are non-refundable from the moment they are booked regardless of notice – typically internal flights, permits, and hotels booked on non-refundable rates. Where your trip includes any of these, we will flag them in your confirmation.

Refunds go back to the account the payment came from, once the refundable amount is agreed. Your bank's own processing time then applies.

Changes you ask for

Tell us as early as you can and we will do what the suppliers allow. Dates, room types, traveller names and route changes are often possible, especially outside peak weeks.

What a change costs depends entirely on what the hotels, transport operators and airlines will do for us – sometimes nothing, sometimes a rate difference, sometimes a full cancellation charge on the part being changed. We will tell you the cost in writing before we make the change, never afterwards.

Changes requested once the trip has started are handled locally where possible, but cannot be guaranteed, and services already booked and unused are not refunded.

Changes or cancellation by us

We plan carefully, and occasionally something still has to move. Minor changes – a hotel of the same standard, a reordered itinerary, a different vehicle – we will make and tell you about.

If we have to make a significant change before departure, or cancel your trip outright for a reason that is not force majeure, we will offer you state the options – e.g. an alternative of comparable standard, or a refund.

Force majeure

We are not liable for failing to perform where the cause is outside our reasonable control. In Nepal that realistically includes weather, landslides, snow closures, earthquakes, flooding, strikes and road blockades, flight cancellations, epidemics, civil unrest, and acts of government.

When that happens our job is to re-plan quickly and keep you informed. We will pass on any refunds we are able to recover from suppliers, but we cannot refund costs that have already been irrecoverably spent on your behalf. This gap is exactly what travel insurance exists to cover.

Your responsibilities

Some things only you can do, and the trip depends on them.

Documents

Making sure your travel documents are valid, correct and carried is your responsibility. We will tell you what the current requirements are for your nationality and route, but we cannot obtain them for you and we are not liable if you are refused entry or transit for want of the right paperwork. Names on your booking must match your ID exactly.

Health and fitness

Tell us at booking about any medical condition, mobility limitation, allergy or dietary requirement that affects your travel. For trekking, satisfy yourself that you are fit for the route – and if you have a heart or lung condition, or are pregnant, or are on medication, speak to your doctor first.

Altitude affects people unpredictably and is not a matter of fitness. Our guides are instructed to descend or turn a group around when they judge it necessary, and that decision is final. It is made for your safety and no refund arises from it.

Conduct

Please behave in a way that respects local customs, the environment and other travellers, and follow the reasonable instructions of guides and drivers. We may end the trip of anyone whose behaviour endangers others or is seriously disruptive, without refund, and any costs arising from it fall to that person.

Your belongings

Your luggage, cash, documents and equipment stay your responsibility throughout. Use hotel safes where they exist and do not leave valuables in vehicles.

Travel insurance

Unless your quotation explicitly includes it, insurance is not part of your booking and you must arrange it yourself. We strongly recommend it for every trip, and for trekking at altitude we would call it essential.

Check that your policy actually covers:

  • The maximum altitude you will reach – many standard policies quietly do not
  • Emergency medical treatment and evacuation, including by helicopter
  • Trip cancellation, curtailment and delay
  • Baggage, documents and personal belongings
  • Any adventure activity in your itinerary

Suppliers and third parties

Parts of your trip are delivered by independent suppliers – hotels, airlines, transport operators, guides and activity providers. We select them with care and hold them to a standard, but they run their own operations under their own terms and conditions, which apply to you as their customer.

Where we book something purely as an agent on your behalf, our responsibility is limited to making that booking properly.

Our liability

We accept responsibility for arranging your trip with reasonable skill and care, and for the acts of our own employees acting in the course of their work.

We are not liable for loss or damage that arises from:

  • Your own act or omission, or that of anyone on your booking
  • The act or omission of a third party unconnected with providing your trip
  • Force majeure as described in clause 7
  • Any activity you undertake independently, outside the confirmed itinerary

Except where liability cannot be excluded by law – including for death or personal injury caused by our negligence – our total liability in connection with a booking is limited to state the cap agreed with your legal advisor.

This clause has real legal consequences and the limits differ by jurisdiction. Have it drafted or approved by your legal advisor rather than published as it stands.

If something goes wrong

Tell us while it is happening. A hotel that is not what was promised, a vehicle that has not arrived, a guide who is not doing their job – call +91 63900 02936 or message the same number on WhatsApp, and give us the chance to fix it there and then. Most of it we can sort within the hour.

What we cannot fix is something we only hear about after you get home. If a matter is still unresolved when your trip ends, write to info@tripnepal.co.in within state your complaints window of returning, with your booking reference and the details, and we will respond in writing.

Photographs and website content

Photographs and videos on this website illustrate the destinations and the kind of experience on offer. Mountain views depend on weather and season, and hotel rooms vary between rooms in the same property.

We may take photographs during a trip for our own promotional use. If you would rather not appear in them, just tell your guide or write to us – that is a perfectly normal request and no explanation is needed.

The text, images, layout and design of this website belong to us or our licensors and may not be copied or reused without our written permission.

Governing law

These terms are governed by the laws of India, and the courts at state the city whose courts have jurisdiction shall have exclusive jurisdiction over any dispute arising from them.

If any clause here is found to be unenforceable, the rest continues to apply. If we do not enforce a term on some occasion, that does not mean we have given it up.

We may update these terms from time to time. The version that applies to your booking is the one in force on the date your booking was confirmed, and the “last updated” date at the top of this page tells you which version you are currently reading.
